Nuestro post de hoy hace referencia a un importante tema que nos viene de la mano de Roberto Donoso, Colaborador e Instructor de Forensic Science Training (FST).
Roberto Donoso es un Investigador Criminalístico Chileno, cuenta con un Postgrado en medicina legal, Diplomado en Lofoscopía y método ACE-V tercer nivel, además de diversos cursos en España, Colombia, Perú y Argentina. Es miembro directivo del Colegio de Criminalistas de Chile (COLCRIM), Miembro del Colegio Internacional de Investigadores Forenses (CIIF) México. Colaborador de Forensic Science Training (FST) Colombia y Criminalística Moderna en Argentina. Actualmente está inscrito en el listado de peritos de la Ilustrísima Corte de Apelaciones y presta servicios para la Defensoría Penal Pública en Chile.

Con vasta experiencia en la investigación de homicidios, muertes sospechosas, delitos sexuales, robos y narcotráfico, participando en juicios en calidad de perito en diversos tribunales penales del país, con más de 500 investigaciones realizadas durante once de trayectoria.
Teniendo como resultados, condenas, absoluciones, abrir casos que han estado archivados durante largo tiempo.
En el mes de Febrero del año 2020, decide crear la empresa Investigaciones & ciencias forenses EIRL, donde en un corto tiempo ya ha realizado diversas investigaciones de connotación nacional e internacional.
EL INVESTIGADOR CRIMINALISTCO DE LA DEFENSA
Tal vez, la función de investigador criminalístico para la defensa no es tan conocida, pues son las propias policías y el ministerio público las encargadas de hacer el trabajo investigativo. La labor que se realiza se centra principalmente en corroborar o descartar la teoría del caso que plantea el abogado defensor. Entre las diligencias investigativas o peritajes que realiza, se encuentra la revisión de la carpeta investigativa o expediente, concurrencias a las escenas de crimen, entrevista con el imputado, búsqueda de testigos, establecer si los protocolos en la escena se realizaron de forma correcta, verificar el correcto levantamiento y resguardo de la evidencia, entre otros. Al finalizar la investigación, se entrega un informe al abogado defensor en donde se explica las operaciones realizadas, resultados y conclusiones, siendo el abogado quien determina si dichas conclusiones sirven para su teoría del caso y así que el perito o investigador se presente en la corte a declarar en posible un juicio oral. A través de estas investigaciones, se han podido demostrar la inocencia de un imputado, se han rebajado condenas, entre otros. Esta labor investigativa, muchas veces es mal vista para las víctimas o el resto de la sociedad, siendo llamados en algunas ocasiones como “mercenarios” a estos profesionales que trabajan para la defensa.
Haciéndose presente que, el trabajo que realiza un investigador criminalístico o perito tanto oficiales o de partes, es completamente imparcial. No teniendo relación los costos monetarios asociados al servicio prestado con alguna conclusión favorable para el cliente. Ya en el año 2021 en plena pandemia, Roberto Donoso crea la empresa Investigaciones y Ciencias Forenses, en donde ha trabajado casos de connotación nacional e internacional en Chile. Por nombrar algunos de ellos es el caso de la ahora senadora electa quien perdió la vista en el estallido social del año 2019. Otro caso por nombrar es de una modelo que perdió la vida cayendo del piso doce en Santiago de Chile, caso que aún está en investigación.

Today’s post refers to an important topic that comes from the hand of Roberto Donoso, Collaborator and Instructor of Forensic Science Training (FST).
Roberto Donoso is a Chilean Criminalistic Investigator, he has a postgraduate degree in forensic medicine, a diploma in Lofoscopy and ACE-V third level method, as well as several courses in Spain, Colombia, Peru and Argentina. He is an executive member of the College of Criminalists of Chile (COLCRIM), Member of the International College of Forensic Investigators (CIIF) Mexico. Collaborator of Forensic Science Training (FST) Colombia and Criminalística Moderna in Argentina. He is currently registered in the list of experts of the Illustrious Court of Appeals and provides services for the Public Criminal Defense in Chile.

THE CRIMINALISTIC INVESTIGATOR FOR THE DEFENSE
Perhaps the role of the criminal investigator for the defense is not so well known, since the police and the Public Prosecutor’s Office are in charge of the investigative work. The work performed is mainly focused on corroborating or discarding the theory of the case put forward by the defense attorney. Among the investigative diligences or expert reports performed are the review of the investigative folder or file, visits to the crime scenes, interviews with the accused, search for witnesses, establish whether the protocols at the scene were carried out correctly, verify the correct collection and safeguarding of evidence, among others. At the end of the investigation, a report is delivered to the defense attorney explaining the operations performed, results and conclusions, being the attorney who determines whether these conclusions are useful for his theory of the case and thus the expert or investigator to appear in court to testify in a possible oral trial. Through these investigations, it has been possible to demonstrate the innocence of an accused, and sentences have been reduced, among others. This investigative work is often frowned upon by the victims or the rest of society, being sometimes called «mercenaries» to these professionals who work for the defense.
It should be noted that the work performed by a criminal investigator or expert witness, whether official or on behalf of the parties, is completely impartial. The monetary costs associated with the service rendered are not related to any favorable conclusion for the client. In the year 2021, in the middle of the pandemic, Roberto Donoso created the company Investigaciones y Ciencias Forenses, where he has worked on cases of national and international importance in Chile. To name a few of them is the case of the now elected senator who lost her sight in the social outbreak of 2019. Another case to name is that of a model who lost her life falling from the twelfth floor in Santiago de Chile, a case that is still under investigation.
