A través de Laura Alejandra Caro Calderón , Tecnóloga en Criminalística y Ciencias Forenses de Colombia, vamos a descubrir cuál es el auténtico papel del investigador criminal privado frente a la toma de entrevistas judiciales.
«La verdadera importancia de la entrevista radica en la labor y preparación del investigador, quien más allá de formular preguntas y escuchar respuestas, tendrá el desafío de comprender y saber dar manejo a los diversos procesos mentales de recordación creados previamente por el entrevistado; de acuerdo a características propias de la persona y por consecuencia de una entrada sensorial de información y un procesamiento de la misma, para finalmente ser almacenada en el cerebro, recuperada y posterior a ello, ser utilizada la hora de responder preguntas.
¿Recuerda usted qué hizo hace una semana? Tal vez no entienda el sentido de esta pregunta, sin embargo, con la respuesta brindada podemos apreciar los diversos procesos de recordación e incluso de olvido que hace el cerebro frente a situaciones específicas; de la misma forma funciona en el ámbito judicial, específicamente hablando del desarrollo de una entrevista, conocida como una de las actividades primigenias, caracterizada por ser una técnica investigativa donde se lleva a cabo una serie de preguntas a diversas personas conocedoras o quienes pueden brindar información acerca de un hecho que se investiga.
En función de lo mencionado anteriormente y teniendo en cuenta los diferentes escenarios a los cuales se puede enfrenar un investigador criminal privado, me permito nombrar algunos factores importantes para llevar a cabo este procedimiento de forma exitosa
la Observación y conocimiento del entrevistado, si bien es cierto, en muchas ocasiones, no se tiene la posibilidad de adquirir información acerca de la persona a entrevistar; es por ello que resulta indispensable el observar detalles previos, durante y posteriores al procedimiento, como rasgos morfológicos, accesorios utilizados, vestimenta, características al expresarse, si el entrevistado se siente cómodo con el procedimiento o por el contrario esta tenso, consistencia del relato; con base en ello, se dará paso al siguiente aspecto conocido como “rapport”, donde el investigador criminal privado tendrá una idea de cómo iniciar la entrevista, generar un acercamiento sano, respetuoso y útil para el desarrollo del procedimiento, posterior a ello, la atención y astucia, serán dos pilares fundamentales para la adquisición de información, donde se focalizará toda la atención al relato que el entrevistado aporta, para realizar las preguntas adecuadas; es preciso mencionar que el investigador criminal privado deberá hacer omisión a cualquier tipo de pregunta sugestiva, capciosa e inútil.

The role of the private criminal investigator in the taking of judicial interviews
Through Laura Alejandra Caro Calderón , Technologist in Criminalistics and Forensic Sciences of Colombia, we will discover what is the real role of the private criminal investigator when it comes to taking judicial interviews.
«The real importance of the interview lies in the work and preparation of the investigator, who beyond asking questions and listening to answers, will have the challenge of understanding and knowing how to manage the various mental processes of recall previously created by the interviewee; according to the characteristics of the person and as a result of a sensory input of information and processing of the same, to finally be stored in the brain, retrieved and subsequently be used when answering questions.
Do you remember what you did a week ago? Perhaps you do not understand the meaning of this question, however, with the answer given we can appreciate the different processes of remembering and even forgetting that the brain does in specific situations; in the same way it works in the judicial field, specifically talking about the development of an interview, known as one of the primordial activities, characterised by being an investigative technique where a series of questions are asked to different people who know or who can provide information about a fact that is being investigated.
Based on the above and taking into account the different scenarios that a private criminal investigator may face, I would like to name a few important factors to successfully carry out this procedure.
Observation and knowledge of the interviewee, although it is true that on many occasions it is not possible to acquire information about the person to be interviewed; this is why it is essential to observe details before, during and after the procedure, such as morphological features, accessories used, clothing, characteristics when expressing oneself, whether the interviewee feels comfortable with the procedure or on the contrary is tense, and the consistency of the story; Based on this, the next aspect known as «rapport» will follow, where the private criminal investigator will have an idea of how to start the interview, generate a healthy, respectful and useful approach for the development of the procedure, after that, attention and astuteness will be two fundamental pillars for the acquisition of information, where all the attention will be focused on the story that the interviewee provides, to ask the right questions; it is necessary to mention that the private criminal investigator must omit any type of suggestive, captious and useless question.
